Functions

 

The Trade Dispute Resolution Commission (TDRC) is responsible for establishing and administering an effective framework for the resolution of international trade disputes and for promoting fair trade practices in Pakistan. Its key functions include:

1. Trade Dispute Resolution

• Initiate proceedings relating to trade disputes between parties. 

• Adjudicate disputes and issue orders, determinations, and decisions. 

• Provide a comprehensive mechanism for the swift and effective resolution of international trade disputes involving goods and services. 

• Facilitate dispute resolution through: 

o Negotiation and referral mechanisms. 

o Determinations by the Commission. 

o Conciliation under UNCITRAL Conciliation Rules. 

o Arbitration under the Arbitration Act, 1940. 

o Resolution through designated Commercial Benches of High Courts. 

o Assistance from representative offices, embassies, and missions abroad. 

2. Advisory and Regulatory Functions

• Advise parties on proposed actions relating to trade disputes. 

• Ensure compliance with the Act, rules, regulations, and guidelines. 

• Monitor dispute resolution processes and intervene in cases of undue delay. 

• Maintain high standards of integrity and professionalism among mediators, conciliators, and arbitrators. 

3. Institutional Development

• Establish and promote arbitration and alternative dispute resolution (ADR) institutions in Pakistan. 

• Maintain a centralized database of chambers of commerce, trade bodies, and registered trade disputes. 

4. Trade Policy and Advocacy

• Promote fair trade through advocacy and policy support. 

• Review trade-related policies and provide recommendations to the relevant government authorities. 

• Contribute to the development of a business-friendly trade environment. 

5. Capacity Building and Awareness

• Conduct training, capacity-building programs, and consultations on international trade and dispute resolution. 

• Train commercial counsellors and community welfare attachés posted abroad to effectively handle trade disputes. 

• Organize seminars, workshops, and forums to promote awareness and discussion of trade dispute issues. 

• Disseminate information through the Commission's website, including rules, regulations, guidelines, and educational materials. 

6. Trade Facilitation and International Cooperation

• Facilitate and promote international trade involving Pakistani and foreign businesses. 

• Build confidence and trust between local and foreign traders through reliable dispute resolution mechanisms. 

• Enhance Pakistan's reputation as a credible and dependable trading partner. 

• Develop cooperative relationships with counterpart institutions in other countries. 

• Ensure the efficient and timely resolution of trade disputes in accordance with prescribed procedures.
